This Privacy Policy is effective as of October 2, 2006.
Kapture helps you manage knowledge by capturing and storing the web pages you visit at internet websites (the "Service"). Providing such a service necessarily requires us to collect certain information about you and your web browsing sessions. Because we understand the importance of your privacy, we take safeguarding your privacy very seriously. We are providing the following Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of the personally identifiable information collected from you during your use of kaptureinfo.com (the "Site") and the Kapture browser plugin (the "Plugin").
This Privacy Policy may be updated from time to time for any reason. We will notify you of any material changes to our Privacy Policy by posting the new policy on the Site. We suggest that you consult the Site regularly to check for any changes to this Privacy Policy.
If you have any questions about this Privacy Policy or our privacy practices, please contact us at support@kaptureinfo.com.
In order to take advantage of the Service, you must register for an account with Kapture and install the Plugin. Information collected during the registration process includes your username, email address, account password, and IP address. Because your username may be visible to other users, we recommend that you choose a username that does not reveal your real name. Should you decide to sign up for the subscription component of the Service, we will also collect your payment information, including your full name, credit card number, billing address, and phone number. We may use all of the personally identifiable information you provide in order to provide the Service, to provide customer support and to improve the Site and Service generally.
Web Browsing Sessions
One of the primary features of the Service is the ability to capture and archive some or all of the web pages you browse and make them available to you via the Site in one or more searchable Kapture sessions ("Sessions"). The technology essentially performs a screen capture of every web page you visit. By default, the Plugin will capture only unencrypted web pages. Therefore, your most sensitive personal data will not be captured, unless you opt in to the capture of secure web pages via the Plugin preferences. If you choose to do that, some of your more sensitive personal data may be collected. For example, if you have enabled this feature in the Plugin and you are logged in to your bank account at your bank's website, your bank account username, account number, account balances, and other related information would be collected and stored by Kapture on the Site. This information is stored securely (for more information about security, refer to the Security section below) and is not shared by Kapture with any third parties, unless you share it via Session sharing with one or more Kapture users, or as otherwise described herein. In addition, you can avoid the capture of specific websites by adding those websites to the "blacklist" via the Plugin, or via the preferences page on the Site. The blacklist is a list of websites for which Kapture will not capture any data. Also, you can edit your browsing sessions to remove any sensitive information.
You may choose to share certain pages from your archived Sessions with others either by sharing a Session specifically with another user or, in some cases, by making a Session publicly available and searchable. You should be careful when making Sessions publicly available because any personally identifiable information contained in those Sessions will be available to others. You should also keep in mind that, even if no single piece of information identifies you, the aggregation of your browsing history may allow someone to identify you.
Kapture will analyze your Sessions in order to create your private search index and "topic identifiers." Kapture will use these topic identifiers to place ads on Sessions shared with unsubscribed users. For more information about Kapture's advertising practices, refer to the section below titled, "Advertising."
Site Usage Data
When you visit the Site, we automatically collect data about your visit, including your IP address, and non-personal data such as your browser type, the pages you visit, the search terms you use, and any advertisements on which you click. This information provides us with data about user activity and helps us improve the usability and reliability of the Site and Service. This information is automatically correlated with your username when you are logged in to the Site. However, we only use this non-personal data when you contact us for technical support related to your access to the Site, to provide you with targeted advertising as described under the Advertising section below and to provide and improve the Site and Service.
Cookies
Like many websites, we use "cookies" to collect information. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for two purposes. First, we use persistent cookies to save your registration ID and login password for future logins to the Site. Second, we utilize session ID cookies to enable certain features of the Site, to better understand how you interact with the Site, and to monitor aggregate usage by users and web traffic routing on the Site. Unlike persistent cookies, session cookies are deleted from your computer when you close your browser. Third party advertisers on the Site may also place or read cookies on your browser. You can configure your browser to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, if you do not accept cookies you may not be able to use all portions of the Site or all the functionality of the Service. You can learn more about the use of cookies by visiting http://networkadvertising.org or http://en.wikipedia.org/wiki/HTTP_cookie.
Phishing:
We do not and will not, at any time, request your credit card information, your Kapture ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. Identity theft and the practice currently known as "phishing" are of great concern to Kapture. Safeguarding information to help protect you from identity theft is our top priority. For more information about phishing, you may want to visit the Federal Trade Commission's website at http://www.ftc.gov/bcp/conline/pubs/alerts/phishingalrt.htm.
Emails
There are a number of email addresses through which you may email Kapture. You may also email your Sessions to third parties. When you send an email to Kapture, or to a third party through the Site, your full name and email address are transmitted to Kapture. In addition, email addresses you provide when sending Sessions to third parties may be stored in your account in order to build your address book. Any other personally identifiable information you choose to include in an email message would also be transferred to and stored on Kapture servers.
Surveys and Feedback
From time to time Kapture will ask for your feedback via surveys. Any information collected via these surveys will only be used to improve the Service.
Kapture's computers will analyze your Session and Site usage information in the aggregate and coordinate with third party advertising companies in order to serve you with targeted advertising. Kapture computers may also analyze the Sessions that you share with others to provide them with targeted advertising from such companies. Such third-party advertising companies may use personal information (not including your name, address, email address or telephone number) about your visits to this Site and the websites captured in your Sessions in order to measure advertising effectiveness and to provide advertisements about goods and services that may be of interest to you. In some cases, Kapture's advertising partners may serve ads that are keyed on certain keywords or domain names; the Site will then serve advertisements in conjunction with Sessions that match those words. Occasionally, your personally identifiable information may match up with one or more of these advertiser keywords. In those cases, you may receive an ad targeted to you using that information. For example, if you live in San Francisco and have entered your address on an archived page in one of your Sessions, you may see ads for San Francisco restaurants. You hereby consent to such use of your personal information.
Except as set forth in this Privacy Policy, we will not share your personally identifiable information with third parties. However, we may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who visited (and thereby captured) a website, searched for a particular term, or clicked on an advertisement. Such information does not identify you individually.
Community Information
Depending on how you configure your preferences and how you use the Site, some of your personally identifiable information may be shared via the Site with other users. When you share a Session with another user, that user will be able to view all the information contained in that Session. This information will include your username and may include any personal information contained in an individual page within the shared Session and certain other metadata associated with your username and Sessions.
Third Party Service Providers
We engage certain trusted third parties to perform functions and provide services to us. These third parties may have access to some of the personally identifiable information you provide, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the privacy and security of your data.
Compliance with Laws and Law Enforcement
We may choose to disclose some or all of your information to the government, law enforcement officials, or private parties if we, in our sole discretion, believe it necessary or appropriate to comply with the law, to respond to legal complaints, to comply with legal process (including subpoenas), to protect the rights of Kapture or a third party, to ensure the safety of the public or any person, or to prevent or stop any illegal, unethical, or legally questionable activity.
Changes in Corporate Ownership
If any or all of the assets of Kapture are acquired by, or merged with, another entity we will share some or all of the information described in this Privacy Policy with that entity.
You may access and modify certain of your personally identifiable information on the Site by going to the preferences page. You may also request the modification of any personally identifiable information stored on the Site by emailing us at support@kaptureinfo.com. Also, you may access, modify, or delete any of your Sessions when you are logged in to the Site.
We place great importance on the safety and security of your personally identifiable information. We employ procedural and technological measures-including strong encryption-in an attempt to protect your information from unauthorized access and use. Although we do attempt to keep your personally identifiable information secure, no security measures are perfect; there is always a possibility that a security breach could occur, resulting in the release of personally identifiable information.
We may send you emails from time to time informing you of updates to the Service, the Plugin, or the Site. If you do not wish to receive such emails, you may opt out of receiving them via the preferences page.
The Site contains links to other websites in several places. When the Site displays the pages archived during a Session, the links in those pages will be active. Also, Kapture's advertisers will provide links to information within their ads. You should pay particular attention to which website you are visiting when submitting any personally identifiable information. This Privacy Policy addresses the use and disclosure of only that information that we collect from you through the Site and the Plugin. Different rules may apply to information you submit to other websites.
The Site is not directed toward children under thirteen years of age. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us at support@kaptureinfo.com. If we become aware that a child under thirteen has provided us with personally identifiable information, we will remove such information from our files.
